The Seventh Judicial District Commission on Judicial
Performance recommends that Judge Ben F. Eden BE
RETAINED. Of the 9-member Commission, 8 were eligible to
vote; all 8 voted in favor to recommend retention.
Judge Eden is a 1986 graduate of the University of Colorado School
of Law. He spent approximately two years in private practice and
eight years as a deputy district attorney before being appointed
to the County Court bench in April 1997. Judge Eden's position is
defined by the state as a part-time appointment (85% FTE). Judge
Eden, aside from his work on the bench, periodically speaks in area
schools on legal matters.
Judge Eden's case load consists of 15% civil and 85% criminal.
Ninety-five percent of attorneys responding to the evaluation recommended
that Judge Eden be retained in office, 5% recommended that he not
be retained. Of the non-attorneys 79% recommended retention, 21%
recommended non-retention.
The Commission observed Judge Eden to be punctual, mannerly and
attentive to the participants in his courtroom. Judge Eden manages
his docket in a efficient manner, makes his rulings based on merits
of the case at hand and applies the law fairly. Judge Eden displays
a strong work ethic and intent to be a good judge. He acknowledges
that there are occasional complex cases that require him to issue
more timely decisions. He recognizes his need and seeks to improve
his ability to communicate with non-lawyer participants in judicial
proceedings.
Based on information obtained through public hearings, interviews
with attorneys and non-attorneys and a personal interview, the Commission
found Judge Eden to be a very competent judge. He is willing and
able to address any shortcomings in his performance.
